Order On order of the Court, the application for leave to appeal is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the decision of the Workers' Compensation Appeal Board dated May 7, 1991, that affirmed the 1990 decision of the magistrate to deny defendant's petition to stop compensation benefits to the plaintiff. The Workers' Compensation Appeal Board's file establishes that the Appeal Board decision is a nullity because the only appeal pending before the Appeal Board was defendant's appeal from the 1985 decision of an Administrative Law Judge initially awarding disability benefits to the plaintiff. We REMAND the case to the Workers' Compensation Appellate Commission for further proceedings consistent with this order. We do not retain jurisdiction.
